JUDGMENT INTRODUCTION [1] This is an appeal from the decision of the Circuit Court, Accra delivered on 2nd December, 2013. [2] The brief facts of the case as found by the trial court are that the Complainant, a taxi driver lives at Mamprobi. On 13th February, 2011 at about 2am, the Appellant hired the Victim’s taxi cab with registration number GS 6212- 10 from Circle to Odorkor. The Appellant then directed his Victim to drive to a place behind the main Odorkor Terrazzo road but on reaching a yellow kiosk in front of a certain house, the Appellant asked his Victim to stop. Immediately, the Appellant put off the ignition as his accomplices emerged from the back of the kiosk wielding cutlasses and a pistol. The Appellant together with his other accomplices attacked their Victim and took away his vehicle. A report was later made to the Police and the Appellant was identified and arrested.
