JUDGMENT INTRODUCTORY BACKGROUND [1] By an Order of Transfer made on 20th October, 2016, by the then Chief Justice, Her Ladyship Georgina Wood, JSC., (as she then was), pursuant to the decision of the Supreme Court in the matter of THE REPUBLIC v. HIGH COURT, (CRIMINAL DIVISION); EX-PARTE FRANCIS ARTHUR AND ANOR., CIVIL MOTION NO. J5/29/2016, this case which was pending before Criminal Court “3” was entirely transferred to this Court, to be continued as part heard case. BRIEF FACTS [2] The accused person herein is charged with two counts of offences, namely; stealing, contrary to Section 124(1) of the Criminal Offences Act, 1960 (Act 29) and forgery of document, contrary to Section 158 of Act 29. [3] The brief facts of the case as presented by the Prosecution are that the Complainant, Ebenezer Lartey (PW1), is the Head of the Security and Investigation Department of Ecobank Ghana Limited.
