RULING The Plaintiff’s Claim is for: 1. An order setting aside the attachment and intended sale of Plot No. 16 as wrongful, unlawful and irregular. 2. An order of injunction directed at the Plaintiff and the Auctioneer, Giant Mart restraining them from judicial sale of Plot No. 16 Gbawe on December 2016 until the final determination of the suit 3. Damages for trespass. 4. Recovery of Possession 5. Costs. Before the Defendant could file its Statement of Defence, the Plaintiff filed an application for an order restraining it from conducting a judicial sale of Plot No. 6 South-West Gbawe Accra in execution of the judgment of the court dated 21st October 2014. The Defendant has filed an affidavit in opposition to the application for an injunction. The Defendant contends that the property which was attached and valued was the one the Plaintiff had used to secure the facility.
