SKYLIMIT STRUCTURE vs. TULLOW GHANA CO.

This is an application for an order to set aside the service of the garnishee Order Nisi served on the garnishee and to discharge the charge created by such service. I have read the application and the supporting affidavit. I have also read the affidavit in opposition. Consideration has been given to the submissions made by both counsel. It is my considered opinion that, although the garnishee order nisi which was made is proper and obtained in compliance with the rules of court, the justice of the mater requires that the service of the Order Nisi and the charge created thereto by it be set aside. In the circumstance the service of the order nisi and the charge thereto created are set aside. I make no order as o cost.
