THE REPUBLIC vs. DISTRICT COURT 1, ADJABENG, ACCRA AND ANOTHER; EX-PARTE: LAM AGENCY AND ANOTHER

This is an application for an order of Certiorari to quash the decision of the District Magistrate Court, Adjabeng, Accra, upon the grounds that the District Magistrate lacked the jurisdiction and had no powers to set aside the orders which were made by the Labadi District Court on 18th August, 2015. A further ground is that the District Magistrate breached the tested rules of natural justice when she proceeded on an application for interlocutory injunction to make final orders disposing off the final subject matter of the suit that was filed before her without taking evidence of the parties. Thus, the Applicants’ complaint is on lack of jurisdiction of the court and also the breach of the rules of natural justice by the said District Court, Adjabeng, Accra. The facts which have led to the instant complaint of the Applicants stemmed from a dispute that appears to have arisen involving the Applicants on one hand and the Interested Party on the other hand, before the Rent Contr.....
