BY COU RT: The Plaintiff in this case Mohammed Abass is a transport operator and a member of the Ghana Private Transport Union (G.P.R.T.U.) and owner of Yutong bus with registration number GC 4810 Z. The Defendant Company is a registered company under the laws of Ghana and has its offices in all the Regional Capitals in Ghana. The Defendant Company engages in the business of plant pool, rentals/leasing of heavy Const ruct ion equipment, as well as Mining, Forestry, Agricultural, Sanitation, Machinery and Equipment and the authorized dealer in Yutong buses. The Plaintiff is a beneficiary of an agreement between the Agricultural Development Bank (ADB) and the Ghana Private Transport Road Union (G.P.RT.U.). Under this scheme members of the G.P.R.TU. acquired Yutong buses from the ADB on credit.
