Before me is a motion on notice for stay of execution pending appeal filed by the Defendant/Applicant, referred to herein as Defendant praying this court to grant him an order staying the execution of the judgment of the District Court dated June 23, 2016, while he appeals the decision of the District Court. It may be prudent at this point to recite a brief synopsis of the procedural history of this case to put the Ruling of this Court in perspective. The judgment of the District Court went in favour of the Plaintiff/Respondent, who is also referred to hereafter as the Plaintiff. The Court granted the Plaintiff the right to recover from the Defendant the following: 1. An amount of $2,700.00 or its equivalent 2. Interest on the said sum with effect from September 2008 till date of final payment 3. Cost of GH¢1,500.00 in favour of the Plaintiff against the Defendant.
