DOMAKYAAREH (MRS), J. A. 1. This is an appeal against the judgment of the High Court, Cape Cost dated 21st October, 2016. The facts that culminated in this appeal are as follows: On 18th April, 2013, the plaintiff/appellant (hereinafter called the appellant), filed a Writ of Summons against the defendant/respondent (hereinafter called the respondent) claiming the following reliefs. “(a) Declaration of title to the land in dispute (b) Recovery of possession of the land in dispute (c) Perpetual injunction restraining defendant, his agents, servants, privies and all persons claiming under and/or through him, from further interfering, in any manner, with plaintiff’s ownership, possession and or control of the said disputed land or any part thereof.
