WELBOURNE, JA This is an appeal emanating from the High Court, Kumasi, dated 23rd June 2012. In this judgment, the Defendant/Appellant will be described as Appellant and the Plaintiff/Respondent as Respondent. Further, the abbreviation ROA means Record of Appeal. The brief facts are that the parties were husband and wife. They were married in accordance with Akan custom in 1987 and later married under statute in Dallas, Texas, United States of America. They subsequently had differences in their marriage and in March 2011, the parties dissolved their customary marriage in Ghana. However by operation of law, they were still married as their marriage had not been dissolved. That marriage was eventually dissolved on 26th January 2015 after the judgment of the High Court was delivered. In the meantime, two houses had been acquired during the subsistence of the marriage, namely, House No.23 Block D, Adiebeba, Kumasi and House No. Plot 1 Block ‘C’, Abuakwa(Kagyase), Kumasi.
