DECISION INTRODUCTION On the 9th of March, 2017, the Commission on Human Rights and Administrative Justice (hereinafter referred to as the Commission) received a written complaint from Hebron Fin Investment (hereinafter referred to as the Complainant) alleging unfair treatment against the Bank of Ghana (hereinafter referred to as the Respondent). COMPLAINANT'S CASE The Complainant grievance is that on the 7th of March 2016 the Respondent issued a press statement online alleging the Complainant's operations was in breach of Section 3(1) of the Foreign Exchange Act, 2006 (Act 723). Section 3(1) of Act 723 provides that: A person shall not engage in the business of dealing in foreign exchange without a licence issued under this Act. As a follow-up to the release of the online press statement, the Respondent took steps to close down its operations and facilities, an action it finds unfair, hence the complaint.
