This is an application filed by the Defendant/applicant herein to “Disjoin the 1st Defendant herein and for the Joinder of the Applicant” pursuant to Order 4 Rule 3 (5) of CI 47. Background The Plaintiff issued out a writ for the following reliefs: (i) Declaration of title to all that piece or parcel of land described in paragraph (1) of the statement of claim. (ii) Recovery of possession (iii) An order for the demolition of the structures erected by the Defendant on the land in dispute. (iv) Damages for trespass. (v) An order for perpetual inunction restraining the Defendant either by himself, assigns, privies, and workmen from interfering with Plaintiff’s quite enjoyment of this land. The land in question is situated at La-Bawaleshie Otele (East-Legon). The Plaintiff says he obtained the land through a lease dated 10th of January 2005 from the allodia owners of La-Bawaleshie Otele lands.
