THE REPUBLIC vs. CHARLES ADU ASINOR
The accused person stands charged with the various counts of Section 124 (1) of Act 29, 1960 Offences and a count pursuant to section 1(1) of Act 749. There are no section 73 of Act 459 consideration in this matter. This is an application for bail pursuant to section 96 of Act 30. It is trite that the position of the law is as couched in Article 19(c) of the 1992 Constitution. This means that there is a presumption of the innocence in all criminal proceedings. What the court is called upon to do at this juncture is to engage in an analysis pursuant to Section 96 (5) (a – d) of Act 30. The court must bear in mind Section 96 (5) (a) of Act 30 whilst coming its conclusion. The court has heard from counsel for the accused though he has been urged with some difficulty to limit the bail application to the criteria assessable by law being Section 96 (6) (a - f) of Act 30.
