JUDGMENT In the Amended Writ of Summons filed on 17th February, 2017, the Plaintiff in his capacity as the sole surviving Administrator of the Estate of the Late Rachael Afieye Welbeck sued Defendants in their capacity as the Administrators of the Estate of John Kobina Asibu. As would soon be seen, the all-important pertinent issue in this case centered on who is the owner of the disputed property as between Rachael Afieye Welbeck (hereinafter to be referred to as Rachel for short) and John Kobina Asibu (hereinafter to be referred to as John for short) The Plaintiff’s case is that Robert Ayer Ayerson (deceased) was the original owner of the land in dispute. Robert Ayer Ayerson died on 23rd October, 1947. Upon his death, Letters of Administration of his Estate were applied for and granted to Mrs. Rachael Afieye Welbeck (Nee Ayerson) who happened to be the only surviving sister of the said late Robert Ayer Ayerson on or about 14th February 1948.
