JUDGMENT Plaintiff’s case By a writ of summons issued on 26th July 2016, the plaintiff claimed the following reliefs against the defendants: i. Declaration of title to a parcel of land situate at Oyarifa. ii. Perpetual injunction to restrain defendant and their agents from entering the land. iii. Damages for trespass iv. Recovery of possession. The 1st defendant entered appearance through its lawyers and applied to dismiss the action but the application was granted in part as the 2nd defendant who is not an entity known in law was struck out as a defendant and the case continued against the 1st defendant as the only defendant. It is the plaintiff’s case that she bought the land in dispute from the Kplen We family sometime in the year 1995, took possession of the land, erected corner pillars, constructed a fence wall and constructed two single rooms on the land and also placed a caretaker on the land.
