JUDGMENT Plaintiff’s Case By a writ of summons issued on 23rd January 2017, the plaintiff claimed the following reliefs against the defendants: i. Declaration of title ii. Damages for trespass iii. Recovery of possession iv. Accounts of rent collected from the land. The plaintiff described the land over which he has sued the defendants in the following terms: “ALL THAT PIECE OF LAND situate, lying and being at MADINA, ACCRA and bounded on the North by proposed road measuring 80 feet more or less on the South by proposed land measuring 80 feet more or less on the East by proposed road measuring 120 feet more or less on the West by stool land measuring 120 feet more or less and covering an approximate area of 0.22 acre.” It is the plaintiff’s case that in 1979, one Chief Seidu decided to sell his house on a plot of land at Madina to one Madam Gertrude Agyekum but because the land on which the house stood was La stool land and Chief Seidu was only a caretaker, C...
