SAMPSON XEPONU TOMMEY vs. STANDARD CHARTERED BANK GHANA LTD
The plaintiff, Sampson Xeponu Tommey, had previously obtained a judgment against the defendant bank in Suit No. BFS/451/2010 concerning a $10,000 Treasury Bill investment. The judgment did not address the status of this investment, which the defendant admitted was rolling over on a 91-day basis. The plaintiff alleged that after the judgment, he made several unsuccessful attempts to obtain statements and access to the investment and accrued interest. He initiated the present suit seeking orders for account statements, appointment of an independent auditor, payment of sums due, damages, and costs. The defendant denied holding the investment, asserting that the plaintiff had instructed them to stop the rollover, after which the amount was credited to the plaintiff's account and statements provided upon request.
