EBUSUAPANYIN ANDREW K. AMIHERE AND ANOR vs. AIRTEL COMMUNICATION LTD AND 2 ORS
A small stretch of land granted to the 1stdefendant, a Telecommunication company to mount a mast some time in 2009 sparked off the instant suit. Granted by the 2nd defendant, with the consent of 3rd defendant, the land is situate at a place the parties agreeably call BUKETO. The plaintiffs pleadthat the said stretch forms part of a 77.15- acre land belonging to their Alanwoba family of Ezinilibo in the Jomoro district which family the 1st plaintiff heads. They averin their amended statement of claim filed on 28/11/16 that their predecessors AdonleGyanzo and NwiahNkyiNdabia broke the land in its virgin state over hundred years ago. According to them, when the grant was made to the 1st defendant and the latter entered upon same to construct the mast, they caused their lawyers to write to stop the work as they as owners had not made any such grant.
