On the 6th June, 2018, I granted the application filed by the 4th Defendant and reserved my reasons, which I now proceed to give. The core issue which I have been called upon to adjudicate on in this application is as to whether or not the 4th Defendant is to be non-suited in this matter which the Plaintiff is seeking the following reliefs: 1. An order for the transfer of 26 (twenty-six) apartments in Block A together with 8 apartments in Block B in the Villaggio Vista Condominium at East Dzorwulu, Accra 2. Costs inclusive of Counsel’s fees And in the alternate, 3. A refund of the sum of USD19,538,418.00 (Nineteen Million, Five Hundred and Thirty Eight Thousand, Four Hundred and Eighteen United States Dollars) together with interest at the bank rate from 30th day of November, 2013 to the date of final payment. 4.
