GHANA HOME LOANS LIMITED (PLAINTIFF) vs. RICHARD PANFORD (DEFENDANTS)
This is an application for Stay of Execution and to pay the Judgment Debt by instalments. I have read the application and the supporting affidavit. I have also read the affidavit in opposition. I have given consideration to the principles governing the grant or otherwise of applications of this nature. I must say that upon reading the affidavit in support of the application I find no justification for the filing of the present application. There is no matter pending in any Court in respect of the judgment which the Defendant/Applicant seeks to stay its execution. No appeal or review is pending. There is also no process pending for determination to warrant the filing of this application. The only reason which the Defendant/Judgment Debtor/Applicant gave for the stay is that he wants to pay the judgment debt by instalment.
