MEDIA GENERAL GH LTD (PLAINTIFF) vs. GHANA BROADCASTING CORPORATION (DEFENDANT)

Parties have reached a post-judgment agreement for Defendant/Judgment/Debtor to pay the judgment debt by instalments. The Courts attention has been drawn to the fact that the Defendant/Judgment/Debtor has issued the first cheque. Subject to it being honoured, I find that the Defendant/Judgment/Debtor has exhibited good faith. Although, instalment payments is not a sufficient ground to stay the execution of a judgment, I find it necessary in the present circumstances to stay the execution of the judgment so as the parties agreement for the debt to be paid as stated in Exhibit GBC1’ attached to the affidavit in support could be effected. I must note that in the event the Defendant/Judgment/Debtor defaults in its assurances on Exhibit GBC1’, the usual default clause shall apply and the balance outstanding shall become due.
