The 1st Defendant has filed an application for leave to open its defence and for further leave to cross-examine Plaintiffs witness. As usual, the 1st Defendant and its Counsel are absent to prosecute their motion. I have examined the application and I am of the view that it has been filed rather late as the Court entered judgment on the 13th June 2018 at 9:00 a.m. The present application though filed on the same date, to me, was late. Having entered judgment for the Plaintiff, I do not think that the application for leave to open a defence and for further leave to recall Plaintiff is appropriate. In the circumstance, I dismiss the application. I reserved my reasons when I entered the judgment on the 13th June 2018. I now proceed to give my reasons. Reasons read.
