Counsel for Defendant/Applicant moves Motion with Affidavit in Support. I have read the application and the Affidavit in Support and I am of the view that the issue of Cost being excessive ought to have been taken up by the Defendant in their appeal at the appellate Court. I do not think this is a matter for review. Cost is a discretionary matter for the Court. Having awarded the Costs, it should be a question of appeal if Counsel thinks that the Cost is either excessive or should not have been awarded in the first place. Accordingly the Motion is dismissed. No order as to Costs.
