APPLICATION FOR JUDICIAL REVIEW – ORDER 55 RULE 4(1) OF CI47 i. Introduction/Overview [1] This is an application in the nature of Certiorari brought pursuant to Order 55 Rule 4 (1) of the High Court Civil Procedure Rules, 2004 C.I. 47. The Applicant, contends that the Chief Justice, being the Respondent unreasonably exercised her discretionary powers when she transferred his case pending at the High Court “A”, Tema to the High Court “1”, Sekondi. He is therefore praying this Court to declare that the directive contained in the Chief Justice’s letter dated January 4, 2019 was in breach of his right to administrative justice and therefore should be quashed by an order of Certiorari. The Applicant is also praying the Court to declare the Chief Justice’s letter of May 6, 2019 as unreasonable and not in compliance with the requirements of the law regulating the exercise of discretion and therefore should be quashed.
