RICH INVESTMENT AND REALITY (PLAINTIFF) vs. ERNEST & BARBS REAL ESTATE (DEFENDANT)

By a writ of summons issued on the 2nd March 2017, the plaintiff company claims against the defendant company the: (i) Recovery of the sum of Eighty Eight Thousand Five Hundred and Seventy Three United States Dollors (US$88,573.00) representing the service fee of One Hundred Thousand United States Dollars (US$100, 000.00) less the Cedi equivalent of Eleven Thousand Four Hundred and Twenty Seven United States Dollars (US $ 11, 427.00) Defendant independently paid to the lawyer engaged towards Plaintiff’s completion of the registration exercise. (ii) Interest on (i) at the prevailing commercial rate from the 16th day of December, 2016 to date of final payment. (iii) Costs. After the filing of appearance by the defendant, a statement of defence was filed in which the defendant counterclaims against the plaintiff company: (i) A refund of the GH₵50, 000.00 with interest at prevailing commercial rate.
