The instant motion seeks an order of the court to strike out the plaintiff’s writ of summons on grounds that it does not disclose a lawyer’s name as the one who issued the writ on behalf of the plaintiff. The Application is supported by an affidavit The plaintiff/respondent is opposed to the application and has deposed to an Affidavit in Opposition that at the time of the issuance of the writ, the lawyer was licensed to practice as a lawyer in the jurisdiction. It is correct from the endorsement on the writ that instead of stating the name of the lawyer as being the solicitor for the plaintiff, the lawyer stated the name of the lawyer’s company as being the solicitor for the plaintiff as well as the solicitor’s Practising licence number. Exhibit 2 attached to the affidavit in opposition shows clearly that the said solicitor’s practice licence number quoted on the writ was issued to one Alfred Kingsley Bannerman-Williams on the 5th February 2016.
