NESTLE GHANA LTD vs. GODFRIED BOAKYE

The plaintiff, Nestle Ghana Ltd, a company registered under Ghanaian law, sued the defendant, a former employee who held managerial positions including Decision Support Manager and Business Operations Controller. The defendant supervised regional sales controllers and was responsible for financial and administrative oversight. In October 2012, a complaint by the Northern Regional Sales Controller about a missing voucher led to an audit revealing irregular postings in regional accounts. These postings were traced back to the defendant's personal bank account, with a total misappropriation of GHC 374,503.12 alleged by the plaintiff. The plaintiff is a company registered under the laws of Ghana while the defendant was an employee and held the position of Decision Support Manager and before then held the position of Business Operations Controller in charge of sales control. In the defendants former position of Business Operations Controller, according to the plaintiff, he supervised all plaintiffs Regional Sales controllers located in the plaintiffs business regions in their financial and administrative functions, monitored their expenses and reconciled their accounts at each months ending. In October 2012 however, the plaintiff says its Northern Regional Sales Controller reported that a voucher he had sent to the plaintiff’s office in Accra did not reflect in his account.
