EAGLES TELECOM LIMITED vs. BLUETONE COMMUNICATIONS LTD. AND MILLICOM GHANA LTD

Before me is an application filed by the 2nd Defendant/Applicant, referred to hereafter as “Applicant”, seeking an Order to dismiss the suit filed by the Plaintiff/Respondent, also referred to hereafter as “Respondent” for reasons which I will state in the course of this Ruling. The backdrop to the present application consists of the following facts. On February 23, 2018, the Respondent caused a Writ of Summons to be issued on its behalf against the Applicant and another defendant for the following reliefs: a) As against the 2nd Defendant i.
