In this application, the Plaintiff is praying the Court for an Order of Interlocutory Injunction in the form of a freezing or mareva order on accounts of the 1st and/or the 2nd Defendants held by the United Bank of Africa (GH) Limited and Access Bank Ghana Limited to negate the duty of those bankers to pay out funds limited to the Defendants’ liability and being held by those banks, among other consequential reliefs, pending the final determination of the suit which the Plaintiff has filed against them. I have read the various affidavits and statements of case filed by the parties herein. I have also read the written submissions of counsel for both parties as they argued out the various positions of the parties and have given great thought to same. It appears to me that the facts of the matter in dispute are quite uncomplicated. The Plaintiff contends that it entered into a sales and purchase agreement with the Defendants for the supply of a specific quantity of gold upon demand.....
