From the record of proceedings the following facts can be ascertained. The Plaintiff is a limited liability company incorporated under the laws of Ghana and is engaged in Travel and Tour Services including airline ticketing. The Defendant is an educational institution providing primary and Junior High School facilities. The Plaintiff’s case is that in July 2015, it entered into a Service Agreement and a Credit Facility Agreement with the Defendant to facilitate the travelling arrangement of Defendant’s students and teachers to Norway. It is the contention of the Plaintiff that at all material times during the period of negotiations and discussions it dealt with the headmistress of the Defendant’s school as the Defendant’s lawful representative.
