MOTION ON NOTICE FOR AN ORDER FOR STAY OF EXECUTION PENDING APPEAL This is a Motion that was filed by the 1st Defendant/Applicant praying this Honourable court to stay execution of its judgment delivered on October 15th, 2018 upon the grounds stated in the accompanying affidavit which was sworn to by one Lukeman Ibrahim a legal officer of the 1st Defendant/Applicant bank. Before I delve into disposing of this matter, I would note that this motion came up for arguments late yesterday just before the close of business and so the court adjourned the matter for a bench ruling to be delivered today at 08:00 am, which I now proceed to do. The thrust of the case of the 1st Defendant/Applicant is to the effect that it is dissatisfied with the judgment of this court, which I have stated earlier was delivered on the 15th of October, 2018 and it has proceeded to file a Notice of Appeal with the Court of Appeal, as has the Plaintiff/Respondent too, who has appealed against the quantum of ...
