The question which the Court has been called upon to answer in the present application is whether or not this Court should vary, reverse or discharge its Order dated July 10, 2018. In this application, I shall refer to the Plaintiff/Applicant as Applicant and the Defendants/Respondents as Respondents. The relevant facts that led to the filing of this application as gleaned from the Affidavit filed in support thereof by the Applicant is as follows. On May 29, 2018, the Applicant sued the Respondents, jointly and severally, by a Writ of Summons accompanied by a Statement of Claim. The Respondents caused conditional appearance to the suit to be entered on their behalf by their solicitors on June 19, 2018 who subsequently filed a Motion on Notice for an Order to Stay Proceedings in the suit so the matter could be referred for arbitration on the basis of the provisions of a Club Debt Assessment Payment Agreement, a copy of which was attached to the Respondents’ motion of June 27, 20.....
