GYAESAYOR, JA The Defendant/ Appellant herein being dissatisfied with the Judgment of the High Court (Commercial Division) delivered on the 15th day of June, 2017 in favour of the Plaintiff/ Respondent herein have filed the instant appeal. In this appeal the Defendant/ Appellant shall be referred to as the Defendant and the Plaintiff/ Respondent shall be referred to as the Plaintiff. BACKGROUND FACTS The Plaintiff herein on the 12th day of March, 2013 issued a Writ of Summons and its accompanying Statement of Claim against the Defendant herein for the following reliefs; a) Payment of the sum of One million and five thousand and sixty three United States Dollars and forty nine cent (USD 1,005,063.49) being the amount due and owing the Plaintiff by the Defendant which the Defendant has failed to pay since December, 2012. b) An order to the Defendant to perform all its obligations to the Plaintiff under the agreement for the sale of the cars to the Defendant. c) Current bank rat...
