WELBOURNE, JA: BRIEF FACTS: The facts of the case are in dispute. Each party has his/her own version. The facts of the case as narrated by the Plaintiff/Appellant is that she got married to the 1st Defendant/Respondent in the year 1963 under the Ashanti Customary Law at the time the 1st Defendant/Respondent was serving in the Ghana Armed Forces and the Plaintiff/Appellant was a seamstress and a businesswoman as well. After their marriage, they lived shortly in Kumasi and thereafter left for Burma Camp in Accra with the family. Whilst in Accra, the 1st Defendant/Respondent left for middle east for peace keeping mission while she was in Ghana taking care of their children working and paying for their children school fees. When the Defendant/Respondent returned from the middle East, they continued to live in Accra and in the year 1974 she and the 1st Defendant/Respondent put their resources together and acquired Plot No. 18 Block J Kaase-Kumasi for the purpose of putting up a dwell...
