SOWAH, J.A.: This appeal is by the defendant/appellant in respect of the judgment of the trial High Court (Commercial Division) dated 15th May 2014 and the Review of the judgment on 23rd June 2014. Background Facts The Plaintiff issued a writ of summons on 16th May 2012 claiming two alternative reliefs as follows: “A. a. An order for specific performance to compel the Defendant to complete and hand over the house to the plaintiff. b. An order for the payment of an amount of two thousand seven hundred and fifty Ghana cedis being the total sum paid for the rent of alternative accommodation from May 2011 to April 2012. c. Damages for breach of contract. d. Cost of instituting this action including Lawyers cost e. Such further order(s) as this Honourable court deem fit. In the alternative of “A” above; B. a.
