POKU- ACHEAMPONG, JA: This is an appeal in a land matter against a judgment from the High Court (Land Division) Accra. In this judgment the Plaintiff/Respondent, shall hereinafter be referred to as the Respondent, and the Defendant/Appellant as the Appellant. FACTS: The Respondent avers that in 1997 she was granted a piece of land of 0.17 acre by the Sempe Mensah Family of Ablekuma by the then Head of the Sempe Mensah Family, Ebenezer Tetteh Annan Nettey, with the consent and concurrence of the principal members of the said family. The land is more particularly described in schedule “A” of the Statement of Claim. The grant, initially a customary grant, was formalised by the Head of Family and the principal elders and an indenture executed in favour of the Respondent.
