POKU-ACHEAMPONG,J.A The Appellant Ismaila Nunoo Lartey and another person Shola Ogukelende alias OGUSH, the 2nd accused were tried by the High Court (Jury trial) for the offences of conspiracy to commit robbery contrary to section 23 (1) and section 149 of the Criminal Offences Act 1960 (Act 29) and robbery contrary to section 149 of the Criminal Offences Act 1960 Act 29. FACTS The brief facts of the case which are straightforward are as follows. The Appellant claims that following the persistent requests of PW3 one Sulley Asamoah, whom he describes as his brother, he agreed to participate in robbing one Dr. Jonathan Acheampong who was killed in the course of the robbery. The said brother Sulley Asamoah, PW3 in the case at the trial court, was the houseboy of the late Dr. Jonathan Acheampong.
