AGYEMANG JA: In this appeal against the judgment of the High Court Koforidua, delivered on the 25th day of January, 2017, the plaintiffs/appellants seek a setting aside of the judgment at the court below, and such other orders as this court deems fit. The appeal has been brought on the sole ground that the judgment of the court below was against the weight of the evidence led. The matters that have given rise to the instant appeal are the following: The plaintiffs/appellants (hereafter referred to as the plaintiffs), are the paternal grandchildren of the late Nana Agyekumhene and alleged owners of the property contained in the estate of the said paternal grandparent. They brought suit against the first and second defendant/respondents (hereafter referred to as the first and second defendants) seeking inter alia: a declaration of their family’s title and ownership of land situate at Suhum/Akwadum road or Agyemkumhene Akura; recovery of possession thereof; recovery of possession o.....
