AGBEVOR, J.A. This judgment was delivered on the 25th July, 2019 with reasons adjourned to be delivered today. I Accordingly give the reasons. The instant appeal by the Defendant/Appellant, is against the judgment of the High Court, Commercial Division, Accra dated the 28th February 2017 dismissing the Defendant/Appellasnt case. The defendant/appellant being dissatisfied with the said ruling, filed this Notice of Appeal which appears on pages 272-274 of the Record of Appeal as:- a) The judgment is against the weight of the evidence b) The trial judge erred when she held that the plaintiff was entitled to the payments sought on the basis that a valid contract had been concluded between the parties c) The trial judge erred when she found that the plaintiff was entitled to the payment to him of the sum of US$35,000.00 which he described as forfeited deposit for undelivered fabric from China. d) The trial judge again erred in finding the plaintiff entitled to the payment of the...
