OFOE,J.A: In this judgment we shall maintain the description of the parties as they were in the trial court- the appellant as the defendant and the respondents as 1st and 2nd plaintiff. The plaintiffs’ initiated proceedings at the High Court, Land Division seeking the following reliefs: “1. Specific performance of the agreement made between the 1st plaintiff and the defendant for the defendant to transfer title to the 2nd plaintiff 2. 2nd plaintiff claims against the defendant declaration of title to all that piece and parcel of land lying and situate at Ashaley Botwe in the Greater Accra Region of the Republic of Ghana and containing an approximate area of 0.22acres and bounded on the North East by the main road measuring 100 feet more or less on the south East by Donor’s land measuring 95 feet more or less and on the south West by donor’s land measuring 100 feet more or less and on the North West by donor’s land measuring 95 feet more or less. 3. 2nd plaintiff claims ...
