AGYEMANG JA: In this appeal the plaintiff/appellant (hereafter alternately referred to as the plaintiff, or the appellant), seeks a setting aside of the judgment of the High Court, Nsawam, delivered on the 22nd day of December 2016, and the grant of the reliefs sought by the plaintiff. This is an uncommon commercial transaction for the sale of land, gone awry. The facts of the matter are that the plaintiff, the owner of a Ford F150 had an oral agreement with the defendant for the sale to the plaintiff, land at a place called Wangara, Nsawam, belonging to the defendant. The consideration for this transaction was the transfer to the defendant of the Ford F150 vehicle said to belong to the plaintiff. This is how the transaction came about: the plaintiff took the said Ford F150 vehicle took it to a mechanic close to the Nsawam-Accra road for the repair of a faulty engine.
