1 Introduction This is a criminal appeal from the judgment of the Circuit Court (1) Accra dated 17 July 2015 that convicted and sentenced appellant (third accused person, A3) to 15 years term of imprisonment in hard labour (IHL) on charge of dishonestly receiving contrary to s.146(1) of the Criminal & Other offences Act, 1960 (Act 29). The brief facts as contained on the factsheet that accompanied the charge sheet are that on 25 September 2012 at about 11:41pm, the first and second accused persons together with two other persons at large attacked the complainant (PW1) The complainant who was in charge of his vehicle Toyota Land Cruiser Prado GW 2726-12 arrived home at the main gate of his house at Dansoman Sahara, and that in the process of gaining entry in the house with assistance of his watchman at post, the accused persons (A1, A2, and two at large) armed with guns attacked the complainant and the watchman (PW2) at the gate.
