1.0 Background 1.1 Facts in this consolidated suit are wide and extensive, indeed contrasting; culminating in like manner the setting down of varied issues by the pretrial court, My view however is that, the main issue, indeed the principle of law at the heart of the contestation involves and indeed revolves largely around the primary issue of whether from facts of the relationship between the parties, a valid contractual agency relationship exists that the court can enforce. 1.2 This judgment relates to two suits that within a space of one week in July 2017 , plaintiff herein commenced separately against defendants herein; first against Total Petroleum Limited (TPL) , and second, against Hanna Petroleum & Trading Limited (HPTL) for reliefs relating to agency service agreement that plaintiff claims to have executed separately with each defendant.
