The defendant filed the present application for stay on the 2nd October, 2019 and the plaintiff responded on the 7th October, 2019. The matter was fixed for hearing on 7th October, 2019. However, same could not be heard because the defendants had not yet had the opportunity to peruse the affidavit in opposition. The matter was therefore adjourned to this morning for the motion to be moved. The defendants/applicants and their Counsel are not in Court. The Court has however read through the motion paper and its accompanying affidavit and has also adverted its mind to the affidavit in opposition filed by the plaintiff/respondent and the Court is of the opinion that the present application lacks merit and so same should not be granted.
