Ruling on Preliminary legal objection raised by Counsel for Plaintiff The preliminary legal objection raised by plaintiff Counsel has to do with the entry of appearance filed by the defendant/applicant on 8th November, 2019. He says that after judgment had been entered against the defendant on the 24th October, 2019, the defendant ought not to have filed an appearance except with the leave of this Court. The plaintiff Counsel has referred the Court to order 9 rule 6 91) of C.I. 47 which says “ A defendant may not file appearance after judgment has been entered in the action except with leave of Court” The plaintiff Counsel therefore requests the Court to strike out the notice of appearance as well as all other processes that has been filed by the defendant since same were filed without the leave of the Court and also that they were filed after judgment had already been entered in the action.
