COMMODITES PROCUMENT LIMITED vs. EMMANUEL O. MADUAGWU

The applicant, Bernard N. Appiah, is requesting this Court to allow him to join this suit as a second defendant on the ground that he is a bonafide purchaser without notice of the house or property that has been placed in receivership by this Court. The Court has considered the affidavits of both the applicant herein and plaintiff/respondent and has also considered the submissions of both counsel and the Court believes that it is prudent for the applicant to be made a party to the suit so as to ensure an effective and speedy disposal of the substantive suit and also to avoid a multiplicity of suits. In the circumstances the Court orders that the applicant is to be added to the suit as a second defendant. All previous processes are to be served on him at his expense to enable him respond to same.
