The Plaintiff brings the present application under Order 14 rule 1 of the High Court (Civil Procedure) Rules, 2004. The Court has carefully adverted its mind to that rule and has also considered all the submissions of learned Counsel and the Court is of the opinion that relief 4 endorsed on the Plaintiff’s Writ and Statement of Claim is a relief in the nature of specific damages and therefore the Plaintiff ought to lead evidence to establish the said claim. In the light of this, the application for summary judgment is refused. There is no award of cost against the Plaintiff/Applicant. Case to take its normal course. (SGD) JUSTICE ANANDA J.
