JERRY HEWARDS KUKUBOR & ORS. vs. GHANA SCHOOL FEEDING PROGRAM & ANOR.

This matter was slated for judgment today but the Court, after going through the record has seen that the Defendant filed a Statement of Defence on 21st January, 2019 which unfortunately has not been served on the Plaintiffs as at the time the evidence of the Plaintiffs was taken in this matter. In the light of the fact that there is a Statement of Defence on the record, this Court will not deliver judgment in this matter and will rather order the Registrar to ensure that the Statement of Defence filed on 21st January, 2019 is served on the Plaintiffs for the matter to take its normal course. The Court also uses its discretion to set aside the interlocutory judgment entered against the Defendants on 16th August, 2018 and also the proceedings of 15th April, 2019. This Court however awards cost of GH₵5,000.00 against the Defendants for their failure to attend Court despite the service of several hearing notices on them.
