The present application is a request by the defendant/applicant for an order to set aside the plaintiff’s Writ of Summons and Statement of Claim on the ground that the action of the plaintiff/respondent is statute barred since the plaintiff failed or neglected to commence his action within the statutory time limit prescribed under the Limitations Act, 1972 (NRCD 54). The plaintiff has vehemently opposed this application, saying that the application is without merit and should be dismissed because he never slept on his rights but rather filed an appeal against his dismissal from the Ghana Police Service in October 2012 when he received his letter of dismissal in September 2012 and that it was rather the defendant/applicant which failed or refused to determine his appeal hence his resort to this Court for the reliefs endorsed on his Writ and Statement of Claim.
