RULING ON MOTION FOR LEAVE TO AMEND WRIT OF SUMMONS AND STATEMENT OF CLAIM In this application the plaintiff requests for leave to amend his writ of summons and statement of claim on the ground that his instructions to his first solicitor were not fully captured in his writ of summons and statement of claim filed on 31st January, 2019 and that there was the need for his full instructions to be adequately captured to enable him to properly prosecute his case before this Court. The defendant/respondent has opposed this application on the ground that the plaintiff/applicant is seeking to set up an entirely new case by introducing entirely new facts and also that the plaintiff’s application is brought in bad faith and should not be granted by the Court.
