RONALD OPPONG ADOM vs. TAWIAH BEN-AHMED AND METROPOLITAN HEALTH INSURANCE GHANA LTD.

The defendant requests the Court for an order directed at the plaintiff for the production and preservation of vehicle with registration no. GE 9634-17 which is in the Plaintiff’s custody. The defendant also requests for an order for the inspection of the condition of the said vehicle after same has been produced by the plaintiff before the vehicle is preserved pending the final determination of the substantive suit. The defendant says the said Pajero vehicle is the subject matter of its counterclaim against the plaintiff and that the continuous use of the vehicle by the plaintiff with its attendant wear and tear will impact negatively on the vehicle. The plaintiff has opposed this application on the ground that he has an interest in the vehicle because he has been making monthly payments to the defendant for the said vehicle in accordance with the terms of the agreement between him and the defendant (Exhibit ‘A’).
